Article __. Revisions to Lot Dimensional Requirements

To see if the Town will vote to amend the Protective Zoning Bylaw of the Town of Ipswich by:

 

(1) Amending Section "III. DEFINITIONS" as follows:

a. Modify the definition of "Lot Line, Front" as follows: "Lot Line, Front: Any property line dividing a lot from a street. On a corner lot, or a lot with more than one street frontage line, one of the street frontage lines must be permanently designated as the "Lot Line, Front". The remaining street frontage lines will be considered front lot lines for purposes of determining minimum setback requirements."

b. Modify the definition for "Lot Width:" as follows: "Lot Width: The distance between lot lines measured parallel to the front property line at the front of the principal building. In the case of an irregularly shaped lot the parallel line will be measured at an angle no more than 22.5 degrees in either direction from a line that is parallel to the front of the principal building."

c. At the end of the definitions for "Lot, Corner", "Lot Line Front", "Lot Line, Rear"," Lot Line Side", change the wording to "(See Diagram 1, page 9)"

d. Amend "Diagram 1", which is referenced by the definitions of "Lot Line, Corner", "Lot Line, Rear", and "Lot Line, Side", by removing the words "angle not more than 135°" from the second illustration in Diagram 1; and

 

(2) Amending Section "VI.G.5." to read as follows;

"Once a frontage street has been designated, it shall retain such designation permanently, and all other line definitions will follow accordingly."

 

(3) Amending Section "VI. DIMENSIONAL AND DENSITY REGULATIONS" as follows:

a. Revising the "Table of Dimensional and Density Regulations" by: (1) adding, under the heading "Principal Buildings and Structures", a footnote "32." to the number within the column entitled "Minimum Setbacks, Front" for each use listed within the RRA, RRB, and RRC Districts that is assigned a number; and (2) adding, under the heading "Accessory Buildings and Structures", a footnote "33." to the column entitled "Minimum Setbacks, Front" for the use listed for the RRA, RRB, and RRC Districts;

b. Adding to "Footnotes to Table of Dimensional and Density Regulations" two new footnotes, "32." and "33.", said footnotes to read as follows:  

"32. For a corner lot, the setback requirements for street frontage lot lines that are not designated as the "Frontage Street" under Section VI.G.5 shall be equal to the minimum side setbacks requirements."

"33. On a corner lot accessory structures shall be set back from the street frontage at a distance equal to the minimum front setback requirements for principal buildings unless authorized by special permit by the Zoning Board of Appeals.";

 

or to take any other action relative thereto.
